boot.efi set times Operation not permitted

I get this warning in Console when SD executes a scheduled run. It does a Smart Update clone of the boot volume nightly.

10/9/10 4:33:37 AM /Applications/SuperDuper!.app/Contents/MacOS/SDCopy[58446] Warning /Volumes/Mac Pro 3/System/Library/CoreServices/boot.efi: set times: Operation not permitted

Looking at the SD log, this appears to happen a few seconds after /System begins copying.

Is this something I can safely ignore?

I can provide the SD log or other info. System is
